Travis Lynn Rasmussen v. Sasha Nicole Rasmussen

Syllabus

This is an appeal from a final decree of divorce. The trial court found that the husband isa business owner and that his business, known as Choice Pool Care, LLC, constituted amarital asset. It then awarded the wife \a 20% share of the business.\ However, the trialcourt did not value the marital asset. The husband appeals, insisting that the trial courterred in finding the existence of a marital asset and in its equitable division of the asset. For the following reasons, we affirm the trial court's classification of the husband'sownership interest in the LLC as marital property, but we vacate the trial court's rulingregarding equitable division of the asset and remand for the trial court to value the assetprior to equitably dividing the marital estate. The trial court's rulings regarding childsupport and alimony are likewise vacated and remanded for reconsideration in light of thefurther proceedings that are necessary as to the division of the marital estate.
