<p>Criminax. Law — Supreme Court — Jurisdiction — Violation of Town Ordinance.</p> <p>Where defendant was sentenced to pay a fine in the mayor’s court, and appealed to the district court, where, on motions filed by defendant, the prosecution was dismissed, and thereupon the plaintiff town appealed, held, that the Supreme Court has no appellate jurisdiction in such a case over the district court. If it exceeded its jurisdiction in permitting the question of the validity of the town ordinance to be raised fcir the first time on appeal, plaintiff’s remedy was not by appeal, but by resort to the supervisory powers of the Supreme Court.</p> <p>(Syllabus by the Court.)</p>
