<p>MALICIOUS PROSECUTION — - LIABILITY OF COMPLAINING WITNESS FOR COSTS.</p> <p>The superior court has no authority, upon the acquittal of a defendant in a criminal case, to enter judgment for costs against the complaining witness, although the court may find that the complaint is frivolous and without probable cause.</p>
