Municipal Coepobations — Okdinanoes — Street Tax.

_ As neither the charter of the town of Farm-erville nor any other legislative enactment confers upon that corporation the power to impose a per capita tax for the maintenance of its streets and to enforce collection of the same by fine, imprisonment, or sentence to hard labor, and as the exercise of that power is generally prohibited to municipal corporations, it follows that an ordinance in which such exercise is attempted is ultra vires of the town, and hence illegal.

[Ed.
