Syllabus

<p>1. Appeals—reviewing the facts—question of negligence. In an action to recover for a personal injury, the question of negligence of the defendant, and also that of the plaintiff, are questions of fact, and the judgment of the Appellate Court affirming that of the trial court is conclusive upon this court on appeal or error.</p> <p>2. Practice in Supreme Court — abandonment of error assigned. Where no complaint is made as to any of the rulings of the trial court, nor of any of the instructions given or refused, it will be presumed that no errors, based upon such rulings, are insisted on in this court.</p>
