<p>ARBITRATION AND AWARD.</p> <p>Submission to Arbitration Excluding Jurisdiction or Courts Invalid.</p> <p>A clause of a contract providing that “Should any dispute arise regarding the provisions of this contract, * * * the same shall he submitted to three arbitrators. * * * and the decision of such arbitrators shall be final and binding on all parties,” is illegal in that it ousts the courts of jurisdiction; at least, it is inoperative, in that arbitration is not made a condition precedent or bar to bringing action upon the contract itself.</p> <p>[Syllabus approved by the court.]</p>
