Syllabus
<p>Insurance — Contracts — Oral Agreement — Binding Memorandum. An oral contract of insurance is effected where the same was solicited by the agent’s employee, agreed to by the insured, and .memorandum of the same made out and approved by the agent, specifying the amount, commencement, and duration of the risk, description of the property, rate to be paid, and name of insured, and the insured was informed that the insurance was effected and policy would be delivered.</p> <p>Same — Proofs of Loss — Waiver—Denial of Liability. Proofs of loss are waived where, before the expiration of the time for making the same, the company denies any liability on the contract and the authority of its agent to make the same.</p>
