Syllabus

<p>Street railways — Location of tracks on public road — Liability to abutting property owners — Measure of damages.</p> <p>Where a street railway company locates and constructs its railway on a public road without the consent of the abutting property owners, the measure of damages for which it is liable for injury done to their property by such location and construction is the depreciation in the value of the property, as the result of the change of grade and the construction and maintenance of the railway.</p>
