Syllabus
<p>Limitation of Actions.—An Action by a Vendee Against the Vendor to recover the purchase price paid for land on failure of the vendor to convey as required by the written contract of sale is an action founded upon an instrument in writing, within Code of Civil Procedure, section 337, and must be brought within four years.</p> <p>Limitation of Actions.—Where the Contract of Sale Requires a Conveyance by the vendor “on demand,” the statute does not begin to run against an action by the vendee for breach thereof by the vendor until after demand by the vendee for a conveyance.</p>
