Syllabus
<p>If Sections 2474, 2475, Comp. Laws, confer any rights upon honorably discharged soldiers of the late war, in appointment to office, not common to all legal voters in general, the fact that the applicant for appointment was an honorably discharged soldier of the late war must bo made known to the appointing power at the time and place of appointment. If not, the appointing power has a right to treat all applicants as standing on an equal footing before the law, and a choice made by it, under such circumstances, must be considered binding.</p> <p>(Syllabus by the Court.</p>
