Syllabus

<p>Probate Court—Jurisdiction.—The late Probate Courts had no power save in certain excepted cases, to settle disputes between the heirs or personal representatives of a deceased person and third persons.</p> <p>Surviving Partner—Partnership — Equity — Jurisdiction — Estates op Deceased Persons—District Court—Probate Court.—If all the members of a partnership die, whether within the jurisdiction of the same or of different Probate Courts, the assets, debts, and credits of the partnership do not become confused with the estate of the last surviver, but continue a separate existence, and the rights of the representatives or successors of the several partners can only be determined in a court of equity.</p>
