<p>SYLLABUS (BY THE COURT).</p> <p>1. See. 4149, C. L. 1897, as amended by sec. 4, cbap. 108, S. L. 1901; makes it a penal offense to refuse or neglect to take out a license and pay the penalty prescribed, within thirty days after receiving a notice from the assessor, as provided in the act, and, it is necessary, in an indictment' based upon this section, to charge that such notice was received by the defendant and that he failed, within the time limited, to pay the tax or license.</p>
