<p>SYLLABUS BY THE COURT.</p> <p>Criminal Law — Constitutional Law — Unusual Punishments — Section 1151, C. L. — Section 1151 of the Compiled laws of 1897, prescribing the death penalty for assault upon a train with intent to commit robbery or other felony, does not prescribe a cruel and unusual punishment within the meaning of the Eighth amendment to the Constitution of the United States.</p>
