<p>Forcible Entry and Unlawful Detainer. Lessee never in possession. Code 1906, § 5039.</p> <p>A lessee who has never been in possession of the leased piemises cannot maintain an action of forcible entry and unlawful detainer, under Code 1906, § 5039, governing such actions, against his lessor who denies him the right to enter.</p>
