Syllabus

<p>A defendant must show a valid excuse for failure to plead in time, in order to set aside a judgment by default.</p> <p>A judgment by default establishes the cause of action, and leaves nothing remaining but to assess' the damages; and where the amount is shown in the written pleadings there is no necéssity for a jury.</p>
