<p>Issue devisavit vel non — Testamentary capacity — Undue influence — Evidence insuflicient to go to jury.</p> <p>An issue devisavit vel non should not he directed unless there is sufficient evidence in the case of the alleged lack of testamentary capacity, or alleged undue influence, to justify the court in sustaining a verdict of the jury setting aside the will.</p>
