Syllabus

<p>Orphans’ court — Jurisdiction—Interpleader—Beneficial association.</p> <p>The orphans’ court has no jurisdiction to entertain a petition by a beneficial association which avers the death of one of its members, a suit by the executor of such member against the association for benefits, and a claim by members of the deceased’s family to the ownership of such benefits, and praying an interpleader, between the claimants. If the orphans’ court entertains the petition and appoints an auditor, all proceedings under such appointment are void, and will be set aside by the appellate court.</p>
