Syllabus

<p>1. Motive of Vendor When Sale Attacked.—Where a sale is attacked as being in fraud of creditors, it was not error to permit the vendor, when called as a witness to support the sale, to be asked; “Did you sell for any other purpose than to pay your debts?” nor to allow his answer, ‘ ‘that he sold for no other purpose.”</p> <p>2. Sale by Failing Debtor.—A sale by a failing debtor for the purpose of applying the proceeds of sale to the payment of his debts, is not fraudulent as to creditors not sharing in the proceeds of such sale.</p> <p>3. Fact Case.—See facts held to show a valid sale by a failing debtor.</p>
