Syllabus

<p>Vendor and vendee — Misrepresentations—Rescission—Costs.</p> <p>A sale of land will be rescinded where it appears that the vendee was induced to purchase the land at twice its value by false representations of the vendor’s agents to the effect that there was a large demand for building lots on the land, that a railroad company was about to move its shops to the neighborhood, that a syndicate of prominent capitalists had been formed to secure the land, and that a certain large sum had been offered for it.</p> <p>If in such case plaintiff acts upon the representations without making any inquiry whatever as to their truth, he is guilty of such gross carelessness as will deprive him of his costs in the equity suit to rescind the contract.</p>
