<p>Landlord and tenant — Tenant by sufferance — Holding over — TJse and occupation.</p> <p>Where a person enters into possession o£ premises under a lease from several cotenants, and after the expiration of his term and after a decree in partition proceedings, bolds over, be becomes after tbe partition, a tenant by sufferance, and if tbe allottee of tbe premises does not treat bim as a trespasser by terminating his tenancy, be is liable in assumpsit for use and occupation of the premises.</p>
