<p>(Syllabus by the CourtJ</p> <p>Partition <&wkey;100 — Sale by sheriff or auctioneer SELECTED BY THE PARTIES.</p> <p>Where, under a judgment decreeing a partition by licitation, the property is ordered to be sold at public auction, it is the duty of the judge to direct that it be sold by the sheriff, or such auctioneer as shall be selected by the parties; it being neither his duty nor his privilege to make the selection, save, perhaps, where such parties fail to exercise their right in the premises.</p>
