Syllabus

<p>1. A Demurrer will not be sustained, if the complaint shows that the plaintiff is entitled to any relief whatever.</p> <p>2. Nonsuit — Equity.—A nonsuit is not proper in an equity case.</p> <p>3. GiETS. — The law of gifts does not apply, except where there is an actual delivery to the donee, or some one for him.</p> <p>4. Trust — Donor and Donee. — Where money is given to a third person to be invested for the benefit of another, without control of the donor, a complete trust is created, and it cannot be revoked by the donor afterwards instructing the holder not to invest the money as formerly instructed.</p>
