Syllabus
<p>1. Removal of Causes—Failure of Jurisdiction.</p> <p>Where an alias, summons has been quashed, the federal court having no power to issue process which will subject defendant to its jurisdiction, the action which has been removed to the federal court is within Act Cong. March 3, 1875 (1 Supp. Rev. St. [2d Ed.] pp. 83, 81), § 5, providing that if, at any time after removal, it appears to said court that the action does not involve a dispute or controversy properly within its jurisdiction, it shall dismiss or remand it.</p>
