<p>SYLLABUS BY THE COURT.</p> <p>Where a party is sued on promissory notes and' files' an answer and counterclaim, setting up certain agreements alleged to have been made by the payee of the note at the ■time of the making of. the same, which agreements were conditioned upon the payor of the note doing certain things, and the evidence shows that the payor of the note failed and refused to perform he is not ’entitled to recover under the counterclaim.</p>
