Syllabus

<p>1. Land certificate—Contract to locate—Equity—A written contract between A. and B. stipulated that, in consideration of one-third of the land, A. should locate B.’s land certificate. Held, if A. performed his contract he became the equitable owner of one-third of the land located, and if his equity was not repudiated or barred by lapse of time, and there was no plea of laches or limitation, his vendee could not be evicted by the holder of the legal title.
