Syllabus

<p>1. Replevin. Property loaned. Subsequent sale. Burden of proof.</p> <p>In an action of replevin for chattels loaned by plaintiff to defendant, the burden of proof is on defendant where his defense is that the plaintiff subsequently invested defendant with title to the-property.</p> <p>2. Same. Instruction. Close case.</p> <p>An erroneous instruction on the burden of proof is reversible error where the case is a close one on the facts.</p>
