Syllabus

Plaintiff's wrongful death claim was properly dismissed by the trial court because plaintiff, who would be the beneficiary of that claim, did not do so within four years of the underlying malpractice that resulted in the decedent's death. Plaintiff's arguments that Ohio's statute of repose is unconstitutional were waived because the arguments and claim were not presented to or considered or decided by a lower court.
