<p>Banks and Banking — Chimes—Insolvency—Receiving Deposits —Statutes—Construction. As a criminal law will not be extended beyond its plain terms, the act of 1893, entitled an act punishing bank officers for receiving deposits knowing the bank to be insolvent, and providing that officers of any “banking (institution” so doing shall be guilty of a felony, did not apply to private bankers, but only to incorporated banks; especially in view of the subsequent legislative construction in 1907 (Rem. & Bal. Code, § 3331), extending the law to cover “owners” and in 1909 (Id., §2640), to cover stockholders and employees.</p>
