State v. William Gilbert

Syllabus

The defendant, William Gilbert, appealed from a Superior Court judgment of conviction after having been found guilty by a jury of first-degree sexual assault in violation of G.L. 1956 § 11-37-2. On appeal, the defendant contended that the trial justice erred in allowing into evidence statements that the defendant's roommate made to the complainant after the assault, arguing that the testimony was impermissible hearsay. The Supreme Court held that the trial justice did not err in admitting the testimony because it was not offered for the truth of the matter asserted. Accordingly, the Court affirmed the judgment of the Superior Court.
