Syllabus

The trial court did not erroneously apply res judicata and the law of the case to overrule appellant's post-sentence plea-withdrawal motion. The trial court did not apply res judicata or the law of the case to those aspects of the motion that relied on evidence outside the trial record and raised issues that could not have been presented on direct appeal. The trial court did not abuse its discretion in finding no manifest injustice warranting withdrawal of the appellant's no-contest plea. The trial court had no authority to order a new sentencing hearing to modify the appellant's sentence. Judgment affirmed. (Donovan, J., dissenting.)
