Syllabus

The trial court did not err by overruling appellant's motion to vacate his criminal sentences. Construed as a motion for postconviction relief under R.C. 2953.21(A)(1), the motion was untimely, barred by principles of res judicata, and without merit. Because appellant received the maximum sentence for an offense, the trial court properly imposed a repeat violent offender specification under R.C. 2929.14(B)(2)(a)(iii). Assignments of error overruled and judgment affirmed.
