State v. Terrell Bliss

Syllabus

The defendant, Terrell Bliss, appealed from two judgments of probation violation entered in separate Superior Court cases, stemming from the same adjudication. The cases were consolidated on appeal. On appeal, the defendant argued that the hearing justice erred because the state did not prove by a preponderance of the evidence that the defendant had violated the terms and conditions of his probation. The Supreme Court held that the hearing justice did not err in determining that the defendant breached a condition of his probation by failing to keep the peace or remain on good behavior. Accordingly, the Court affirmed the judgments of probation violation of the Superior Court.
