Syllabus

Conviction and sentence affirmed. The trial court did not err in refusing to admit a recorded interview between defendant and law enforcement because the defendant never sought to admit it for the reasons argued on appeal. In addition, despite some discrepancies in the testimony and evidence presented at the trial as to how the defendant raped the victim, the defendant's conviction does not represent a manifest miscarriage of justice that merits a new trial. Finally, even if it were to be assumed defendant's trial counsel erred in not moving to admit evidence which conflicted with the victim's testimony and by not moving to suppress defendant's statements to law enforcement, the result of trial would not have been any different given the other evidence presented at trial.
