Syllabus
The state board of pharmacy has broad but not unlimited enforcement authority under the terms of Ohio's Medical Marijuana Control Program. Its statutory enforcement powers are not coextensive with those of the Department of Commerce (which licenses medical marijuana cultivators and processors, for example, much as the board licenses medical marijuana dispensaries and registers patients and caregivers). The trial court's decision granting enforcement of a board subpoena is reversed and remanded so that the trial court may consider the enforcement application in light of the contours of the board's statutory authority. Judgment reversed and cause remanded for further consideration.
