Syllabus

The defendant, Luis Roman, appealed a Superior Court order denying his motion to reduce the sentence he received for a conviction on several charges relating to a shooting. On appeal, the defendant argued that the sentencing justice should not have considered a statement he made that he allegedly would have rather engaged in a shootout with police than return to prison. The defendant disputed that he made this statement. By contrast, the state asserted that the defendant waived his right to file a motion to reduce his sentence when he entered a plea agreement and that the sentencing justice fashioned a fair sentence. The Supreme Court affirmed the sentence, determining that the sentencing justice weighed both the aggravating and mitigating circumstances and imposed a proper sentence. Accordingly, the Superior Court order was affirmed.
