The proceedings considered, and held: Misconduct on the part of the court in the cross-examination of witnesses does not appear; an instruction on the subject of attempt was waived, and the evidence indicates commission of a completed crime if any was attempted; and the evidence for the state covered all the elements of the crime of which the defendant was convicted.</p>
