State v. Jason E. Stoots
Syllabus
Jason Edwin Stoots was convicted of second-degree domestic violence after an altercation with his wife in the \drive-thru\ at a Taco Bell. Stoots argues the trial court erred in refusing to charge the law of self-defense and accident. The court of appeals affirmed his conviction. We find no reversible error in refusing to charge the law of accident but find reversible error in refusing to charge self-defense. We reverse the court of appeals and remand for a new trial.
