State v. Hedrick

Syllabus

The trial court's sentencing decision for aggravated assault, a fourth-degree felony, was not contrary to law. The court properly considered all relevant statutory factors set forth in R.C. 2929.11 and 2929.12, imposed postrelease control, and sentenced the appellant within the permissible statutory range. In addition, the trial court did not abuse its discretion in imposing a 180-day jail sentence for assault, a first-degree misdemeanor. A trial court is not required to make an express finding that the defendant committed the worst form of the offense before imposing a maximum sentence.
