Syllabus

<p>Husband and Wife — Offenses—Wife Abandonment — Evidence— Sufficiency. The uncontroverted evidence of the state is sufficient to sustain a verdict of willful wife abandonment and nonsupport, where it appeared that the prosecuting witness and defendant were husband and wife, that he did not support his wife during any of the time in 1913, and prior thereto, that he was a mining promoter, healthy and strong, and maintained an office in the city of S., and had refused to support his wife, who was without funds; in view of 3 Rem. & Bal. Code, § 5933-3, providing that proof of abandonment and nonsupport shall be prima facie evidence that it was willful.</p>
