State of Tennessee v. Amy Upton
Syllabus
The Defendant, Amy Upton, pleaded guilty to four counts of drug-related offenses afterthe trial court denied her motion to dismiss the charges or, alternatively, to suppressevidence seized on the day of her arrest. The motion pertained to the circumstances of herarrest, which occurred in Claiborne County but was effectuated by Union County deputies. As part of her plea agreement, she sought to reserve a certified question of law challengingthe trial court's decision to deny the motion. Following our review, we conclude that thecertified question does not clearly identify the scope and limits of the legal issue reservedas required by Tennessee Rule of Criminal Procedure 37(b)(2)(A). Accordingly, we arewithout jurisdiction to consider the question. The appeal is dismissed.
