State of Minnesota v. Javion Tramel Ladon Henry

Syllabus

In this direct appeal following sentencing, appellant argues that the district court abused its discretion by imposing a ten-year conditional-release period that was unauthorized by law and by including out-of-state convictions in calculating his criminal- history score. Because the district court abused its discretion in both respects, we reverse appellant's sentence and remand for the district court to vacate the ten-year conditional- release period and resentence appellant based on a correct criminal-history score.
