Syllabus

<p>Syllabus.</p> <p>Where a plaintiff alleges that the land he claims is worth more than one hundred dollars, and the defendant, while swearing that it is worth less than that amount, makes a claim for damages arising, if an injunction against him be dissolved, (and the land he claims can not be recovered by him without his recovering the improvements,) the court holds that the questions involved bring the case within the jurisdiction of the Court of Appeals, and that the party cast has the right to an appeal from the judgment of the District Court to the Court of Appeals as the amount involved is more than one hundred dollars.</p>
