Declaratory judgment, Ordinance, R.C. 733.59, R.C. 731.30. In a statutory taxpayer's action for injunctive relief pursuant to R.C. 733.59, the trial court erred in denying appellant's motion for summary judgment as moot as to her request for costs and reasonable attorney fees pursuant to R.C. 733.61 where the action was rendered moot by the municipality's repeal of the ordinance in question prior to judgment.
