Relator's complaint to compel a municipal court magistrate to process her affidavit in accordance with R.C. 2935.09 and 2935.10 fails to state a claim in mandamus. Respondent has no clear legal duty to, among other things, docket and assign a case number to the affidavit, to refer the affidavit to a prosecutor, or to hold a formal probable cause hearing under the Criminal Rules. A court of appeals lacks original jurisdiction to declare the municipal court's screening procedure for affidavits to be unlawful or to issue a prohibitory injunction to restrain the procedure. Motion to dismiss sustained. Writ denied.
