<p>CRIMINAL LAW — CHANGE OE VENUE — APPLICATION — PRESENCE OE ACCUSED.</p> <p>1. Where the defendant in a murder case applied to the judge in chambers, under section 1031 of the Revised Statutes of 1870, for a change of venue, and expressly waived his right to be personally present during the proceedings (being, however, represented therein by counsel), and after a hearing the judge ordered a change of venue, held., that the physical absence of the accused did not have the effect of nullifying the order granting such change of venue; his personal presence not being essential to the validity of the proceedings.</p> <p>(Syllabus by the Court.)</p>
