No party filed objections to the magistrate's decision recommending the dismissal of relator's complaint for writ of procedendo as moot, as the trial court has ruled on the motion that prompted relator to file the complaint. Finding no error of law or defect in the magistrate's decision, it is adopted in in its entirely. Respondent's motion to dismiss and motion for leave to file a motion to dismiss instanter are sustained and relator's complaint for writ of procedendo is dismissed.
