<p>SYLLABUS BY THE COURT.</p> <p>1. Mandamus will not lie against the Commissioner of Public Lands to compel him to issue a deed conveying the’ public lands free from the reservation of the minerals therein, which reservation was contained in the contract of sale, because it is, in effect, an action against the state. P. 387.</p> <p>2. No sovereign state can be sued in its own courts, or any other, without its consent. P. 387</p>
