Syllabus

<p>Trial by Jury—Waiver—Nonpayment op Jury Pee. Laws 1903, p. 50, requiring an advance payment of $12 as a jury fee in civil cases, and providing that its nonpayment shall be deemed a waiver of the right to a jury trial, is not in conflict with Const, art. 1, § 21, providing for the waiver of a jury trial only where consent thereto is given, since consent may be either express or implied, as recognized by the laws in force at the time of the adoption of the constitution.</p> <p>Same—Reasonableness op Pee. The jury law of 1903, p. 50, providing for a $12 jury fee in civil cases is not unconstitutional as imposing any unreasonable conditions upon the right of trial by jury.</p>
