Syllabus

<p>The patent for a lode claim takes the sub-surface as well as the surface, and there is no other right to disturb the sub-surface than that given by § 2322, Rev. Stat., to the owner of a vein apexing without its surface but descending on its dip into the sub-surface to pursue and develop that vein.</p>
