Syllabus

<p>Evidence — Explanation of written receipt — Promissory note.</p> <p>1. In an action on a promissory note where the defendant, the maker, offers in evidence a receipt from the plaintiff purporting to show that the note had been given in payment of certain shares of stock, parol evidence is admissible to show that the shares of stock were not the real consideration for the note.</p> <p>2. A receipt is open to contradiction, explanation or correction; and is not subject to the rule which forbids the admission of parol evidence to contradict a written instrument.</p>
